重構食安風暴:從1979年的米糠毒油事件說起

    連續幾個星期,從英國藍到五十嵐,從茶葉的農藥到知名早餐店使用的雞蛋,食安風暴如連環鞭炮,在你的生活周遭爆開來。對於那些飲料中含有多少ppm毒素的數字,你可能沒什麼感覺;昨天才剛買了一杯英國藍的伯爵茶,喝下去的時候也渾然不察,還因為它能解渴清涼所以高興了一下。但現在你可能提防些,在上學上班途中要買杯飲料前,還要先用手機查查看最新的食安新聞爆料。
 
       時間推移至2013年10月,距今還不到兩年,所以你還算記憶猶新,或說心存餘悸。那天你可能還低著頭,邊嚼著餐廳的食物,邊滑著肘旁的手機螢幕,再邊聽著小吃店電視播送的新聞。忽然間,你抬起頭、豎起了耳朵,與左右兩旁一起嚼著食物的陌生人們面面相覷。電視機上播送著大統公司所生產的特級初榨橄欖油,被檢舉裏頭摻了非橄欖油的成分。低下頭,你繼續嚼著、吞下那些食物,也吞一份恐懼。連續幾天,各大報紙、各個新聞台與獨立媒體,爭相報導著問題油品最新的調查結果,並訪問專家學者,關於這些問題油品中所添入的成分銅葉綠素中,究竟含有多少的致癌率。這起被稱為黑心油風波的食油風暴中,牽連了多家下游市場廣大的食品集團,其後相關的新聞、偵查,成為時下台灣大眾關心的議題;而這起黑心油風暴,也喚起當今許多外食族對食品來歷、安全的重視。
 
       然而,你可曾知道,在三十年前的台灣這片土地上,也曾發生過一起駭人的食油風暴?比起當今被炒得火熱的食安新聞,在戒嚴時代被爆出的聲音顯得薄弱含蓄;與風險社會下、機率被視為傷害的情形不同,這起風暴的後果直接地顯現在食用油品的受害者身上,對他們日後的生活上產生難以結痂的瘡疤。更嚴重的是,這些傷痛在亟需治癒的時間點,被政府與社會淡然處置;而時過境遷,當他們的故事終於在大家遺忘後娓娓道來,那些深刻的疤痕早已留下。
 
       但歷史,會流動;而文字,會說話。當我們回頭觀照過去不曾細究的食安風暴,從不同形式的媒體、不同來源的聲音,形塑一個相似的經歷,你將看到更全面的事件與形變至今的過去,更看到過往的經驗裡,早已埋藏著當代議題的種子,幾十年來仍在等待著這土地的人們去重視並澆灌之。(詳見PDF檔)

    這一個工作坊的主旨是探討:電腦是否能夠模擬法律人的思考,而法律人的思考是否能被電腦模仿。透過電腦的模擬,可以歸納大量的資訊,也可以嘗試對未來的事件作出可能的判斷。

【RCA工殤按法律文件】


            RCA工殤案一審判決書(節錄)
 
  
  

     RCA工殤案中的勞工們經歷了多年的抗爭和訴訟,他們的一審訴訟結果終於在2015年4月17日宣判。這份判決中,重要的爭點有二:一、原告的損害與被告的行為間是否存在因果關係,從而能主張民法第184條的侵權行為損害賠償?二、原告的請求是否罹於消滅時效?

  這份判決的內容非常多,因此這份電子報將收錄判決主文,並摘錄法官針對前兩個重要爭點所寫的部份理由。完整的判決書,請至法學資料檢索系統查詢(網址:http://jirs.judicial.gov.tw/Index.htm )。

Call for Papers: The First SELS Global Workshop for Junior Empirical-Legal Scholars
 
 
The first international workshop for junior empirical legal scholars will be held on December 17th and 18th 2015, at the Hebrew University of Jerusalem. The meeting is co-sponsored by the Society of Empirical Legal Studies (SELS) and The Center for Empirical Studies of Decision Making and the Law.
 
The workshop aims to foster the research of scholars who have recently completed their PhD or have recently been appointed to a tenure track position, by providing them with a forum in which they can present their research and receive feedback from fellow empirical researchers. Approximately ten scholars from around the world (submission criteria specified below) will be invited to the workshop. Each scholar will be assigned a commentator who will discuss their paper. The rigorous academic environment at the workshop will assist junior scholars to develop their ideas. The workshop is also intended to establish a sense of community among empirical legal scholars and help build cooperative relationships between participants.
 
Topics: Papers may touch on any legal field and can employ any empirical methodology.
 
Participation Criteria: To be eligible, an author must be an untenured faculty member at a research university in a tenure-track position; or a tenured faculty member if it has been less than five years since the initial entry level appointment; or a full time post-doctoral fellow or a visiting associate professor at a research university. In addition, the committee will consider the work of authors who do not fit these criteria, but are new to the field of empirical legal studies.
 
Travel: The costs of airfare (coach) and accommodations of authors who will be invited to participate in the workshop will be covered by the Center for Empirical Studies of Decision Making and the Law.
 
Paper Submission: Submissions should be sent to Ms. Ayelet Gordon (ayelet.gordon@mail.huji.ac.il) with the subject line: “Workshop for Junior Empirical-Legal Scholars.”
 
The deadline for submission is June 30th, 2015. Only drafts of complete papers will be considered.

Washington University Law School, the Center for Empirical Research in the Law and Olin Business School are pleased to host the 10th Annual Conference on Empirical Legal Studies (CELS) on October 30 and 31, 2015 in St. Louis, Missouri.
Sponsored by the Society for Empirical Legal Studies, CELS is a highly regarded interdisciplinary gathering that draws researchers from across the country and internationally, bringing together scholars in law, economics, political science, psychology, policy analysis, and other fields who are interested in the empirical analysis of law and legal institutions. Papers are selected through a peer review process and discussion at the conference includes assigned commentators and audience questions.
